The High Court’s order stayed in the OBC case. Big turn in the Supreme Court

OBC CASE: Supreme Court orders in cases related to OBC certificate. The Supreme Court of the country has been rushed by the stay of the High Court. The question raised – How much is the right of the High Court to interfere in the administrative decisions of the state government? The bench headed by Chief Justice DY Chandrachud of the apex court has informed that the case will return to the Calcutta High Court again. However, not in the previous bench – the Chief Justice of the High Court has been requested to form a new bench.

Because, according to the Supreme Court, there are some problems with the observation of the previous bench. In this regard, the Supreme Court has also recommended to change the bench of Justice Tapobrata Chakraborty and Justice Rajasekhar Mantha. Besides, the case is also said to be settled within 6 to 8 weeks.

In this judgment, the Supreme Court practically explained that the OBC Case decision of the state government cannot be canceled suddenly. Now waiting for a new hearing in the High Court. But it is clear – the Supreme Court wants this debate to be resolved quickly and the High Court should consider the matter impartially.

What decision was taken at the hearing?

Eminent lawyer Kapil Sibal made a question on behalf of the state in the hearing of the day. He made it clear to the Supreme Court that the future of many people is facing uncertainty due to the suspension of the Calcutta High Court. This decision needs to be withdrawn immediately. badAfter listening to the statement of the party, the Supreme Court said that no direct suspension can be given on any administrative decision. There is no need to make separate laws in reservation – executive instructions are enough.

As a result, the state government is currently at some relief on the OBC issue. Because, earlier in June, the Calcutta High Court had issued a stay on the new OBC list made by the state. The state went to the Supreme Court challenging that verdict. Due to the order of the High Court, various recruitment processes starting from the admission of students across the state are facing uncertainty.
